TERMS OF SERVICE


General Information

1. By commissioning me, you agree that you’ve fully read and understood my terms and conditions.
2. These terms may change or be updated as needed.


Artists Rights and Usage

I, as the artist, hold all rights to the work I create. You may not, under any circumstances, trace my work, create bases from my artwork, remove my watermark, or make major changes to the artwork. Unless otherwise requested, I reserve the right to use commissioned work to advertise my art, other commissions, sales, etc. If you request, I will not use your commission for these purposes. In any case where the work I complete features your character, I will credit your character as yours.You, as the customer, have the right to use the artwork for personal purposes, such as profile pictures, posting online (with proper credit), etc.I have the right to decline any commission for any reason.Before commissioning me, please ensure you are happy with my past work and enjoy my style. Anatomy or style may vary slightly based on character designs or client requests.Please remember I am human, and mistakes can happen. I am open to feedback and will gladly make revisions (see the revisions section for more details). I ask that all communication remains professional, polite, and respectful from both sides.


Payment

1. Payment must be made in full before I begin working on your commission. I accept payments through PayPal, Kofi, or Vgen.
2. Prices may vary based on complexity, hard deadlines (e.g., needing the commission completed within 48 hours), or additional requests.


Refunds

1. As full payment is required upfront, refunds are only available in special cases. Please ensure commissions fit within your personal budget.2. If I, as the artist, need to cancel the commission for reasons unrelated to the client, I will provide a partial refund based on the progress made and provide the client with the current state of the work (e.g., cleaned-up sketch). This situation is unlikely, so please don’t worry!3. Refunds are fully unavailable once the work is over halfway completed (e.g., linework complete).


Revisions and Alterations

1. I will provide as many progress photos as requested during the sketching phase and allow unlimited revisions (within reason, e.g., adjustments to posing, layout, etc.). If excessive revisions are requested (such as 3+ major changes that involve redrawing large portions of the work), revisions may be cut off.
2. During the line-art or rendering phase, I allow up to two revisions. This may include minor changes in posing, composition, etc. After two revisions, if you are still unsatisfied, we can discuss a fair compensation for additional revisions.
3. Once the work is completed, further revisions will not be accepted. Please ensure you are satisfied with the sketch before I proceed to the final stages.
4. For sketch-based commissions, I only accept one minor revision (e.g., slight pose adjustments). WIPs will not be provided, so any alterations will be made at the end.
You may not use older versions of the work as your own (e.g., posting them on Toyhouse, using them as profile pictures or wallpapers, etc.). This is to prevent abuse of the revisions process to obtain additional artwork from a single commission


Turnaround Time and Deadlines

1. I will provide an estimated completion time at the start of the commission. Turnaround time may vary based on the commission type or complexity.
2. If I require an extension to the estimated time frame, I will notify you promptly.
3. The turnaround time is an estimate. I may finish earlier than expected but will aim to complete the work within the estimated timeframe. This may take longer if revisions are requested.
4. For smaller commissions (e.g., sketches), I aim to complete them within 48 hours. Larger commissions may take longer, but I will strive to finish them within 2 weeks of payment. You can track the progress through our communication or my Trello.


Communication and Delivery

1. All commission-related communication will be conducted through private DMs (e.g., Discord, Twitter, etc.). Please check the platform regularly, as I may need to ask questions related to your commission.2. You are responsible for providing detailed information about your request, including important character design details and reference material. I require a character reference sheet, either a specific commission reference or a full-body depiction of the character.3. The completed artwork will be delivered in a PNG format unless otherwise requested. Delivery can be complete via the site the commission was through, or by email. I will not provide a file with editable layers. If you need revisions, please inform me before the completion of the piece, as stated in the revisions section of my terms of service.


Client's Rights and Commercial Use

1. You may use the commissioned artwork for personal use only (e.g., profile pictures, uploading to Toyhouse, wallpapers, printing for personal display, or use as a personal badge or sticker).
2. You may not:
- Claim the artwork as your own.
- Post without proper credit (ensure that any display of the work on Toyhouse or social media includes proper links to me. On platforms like X, Instagram, etc., please link back to my account or my Carrd).
- Modify, resell, or use the artwork for commercial purposes without prior permission (this excludes cases such as V-Tuber commissions, where prior permission is required to use the art for a model, emotes, etc.).
- Remove my signature or watermark.
COMMERCIAL USEIf you plan to use my artwork for commercial purposes (e.g., for profit, branding), please inform me beforehand. Additional fees may apply.


Prohibited Content

I will not create artwork involving:1. Hate speech, offensive content, politically extreme content, or extreme fetishes (e.g., inflation, vore, etc.).2. In the case of NSFW commissions, I will only draw human genitalia. I will not draw any NSFW content of feral characters or anatomically accurate animal genitalia. I will not draw NSFW or suggestive work of underage or underage-appearing characters under any circumstances.3. I will deny commissions from clients involved in controversial or illegal communities (e.g., feral porn, lolicon/loli artwork, graphic or extreme kinks, etc.).


Custom Designs

If you are commissioning me for a custom design, most terms still apply.1. For custom designs, I allow more flexibility than standard commissions. You may request alterations to the design (e.g., color palette, accessories, etc.) until completion. If too many alterations or large changes are requested, additional fees may apply. I am flexible and want you to be happy with your design!2. Completed designs can be used for various purposes (e.g., mascots, personas, V-Tuber models), as long as proper credit is given. For example, if using the design as a mascot, credit me in a visible manner on the platform where you upload the character. For streaming purposes, include a link to my account in your bio and mention I created the design.3. In most cases, I require clients to have a Toyhouse account. If you don’t have one, I can provide a code for registration. Exceptions may be made on a case-by-case basis.4. You may only resell the design for the price you paid unless additional artwork is purchased. In good faith, I will allow clients to factor in their own work when determining the resale price, provided this system is not abused.5. If you later redesign or revamp the character, you may not remove the credit given to me for the original design. You can redraw or modify the character as you like, but I request that I am still credited as the original creator of the design and reference.
